Here’s something interesting:
BOFI filed a lawsuit against Erhart on October 16, 2015. CEO is repeating that all of his allegations are completely false. Talks about “John Ball resigned abruptly” allegation - Mr. Ball sent a statement to BOFI clearing the record. Mr. Ball resigned due to stress and long hours. Mr. Ball has confirmed with statement sent to company that Mr. Erhart’s statements are false.
Thus no further comments regarding the allegations or questions will be answered. No restrictions whatsoever, M&A or otherwise. Again, no questions on Erhart matter.
I’m paraphrasing as it comes in, but essentially Mr. Ball has refuted a lot of what Mr. Erhart has said about his resignation in his law suit.

Answer: After the law suit, in direct response to it.
Looks like Mr. Ball won’t be the “second whistleblower”.
