New York PFOS Limits Would Be Most Aggressive In Nation

We previously reported on New York’s PFAS drinking water standards, which include PFOA and PFOS enforceable limits and a proposal to add four other PFAS to the state’s enforceable limits list. On March 15, 2023, just one day after the EPA released its proposed drinking water standards for PFOA and PFOS of 4ppt, New York released a Guidance Value (GV) for PFOS of 2.7ppt. While Guidance Values are not enforceable limits, they are precursors to the state setting enforceable limits, so many see the 2.7ppt GV as a signal of what is to come for the state. New York’s PFOS standard would therefore become the lowest level for any PFAS drinking water limit in any state, and it would be more aggressive than the EPA’s own federal standard proposed just days ago.

By way of background, in October 2022, the New York Department of Health (DOH) proposed adding four PFAS to the New York PFAS drinking water standards for PFOA and PFOS. Under the DOH proposal, PFDA, PFNA, PFHxS and PFHpA would be added to the state’s regulated chemicals list, with Maximum Contaminant Levels (MCLs) set at 10 parts per trillion (ppt) for each of the four PFAS. This would mirror the 10ppt standard set for both PFOA and PFOS in 2020. DOH is also proposing a combined MCL of 30 ppt for the six PFAS types. Detections at or above these levels could lead to enforcement actions against companies that the DOH feels contributed to the contamination of drinking water sources.

Now more than ever, the EPA is clearly on a path to regulate PFAS contamination in the country’s water, land and air. These regulations will require states to act, as well (and some states may still enact stronger regulations than the EPA). Meanwhile, individual states are enacting their own PFAS standards, as is reflected in the New York PFAS drinking water standards in effect and proposed. Both the federal and the state level regulations will impact businesses and industries of many kinds, even if their contribution to drinking water contamination issues may seem on the surface to be de minimus. In states that already have PFAS drinking water standards enacted, businesses and property owners have already seen local environmental agencies scrutinize possible sources of PFAS pollution much more closely than ever before, which has resulted in unexpected costs. Beyond drinking water, though, the EPA PFAS Roadmap from 2021 shows the EPA’s desire to take regulatory action well beyond just drinking water, and companies absolutely must begin preparing now for regulatory actions that will have significant financial impacts down the road.


Investors should note that PFA regulations are likely to mean good business for activated carbon manufacturers. That is the best known treatment for contaminated water.

Calgon Carbon in Pittsburgh is probably the leader. Once they were part of Merck, spun off, acquired by Nalco, part of Credit Suez.

Water treatment companies are likely to benefit.

Kuraray Ltd of Japan now owns Calgon. Another player is Cabot maker of Darco and Norit activated carbon.

We just drink water in plastic bottles (Kirkland Signature Purified Water aka Costco). And yep, there are sometimes Kirkland water recalls, as well as recalls on other bottled waters.

Since you’re a particularly “aware” guy for a lot of chemical stuff/processes, what do YOU do for water in your household?

Our local tap water here in Charlotte NC is proclaimed “safe” (of course) and they say “zero water quality violations” but I’m not convinced that means it’s adequate. Not sure current “standards” are adequate. Aluminum is 29ppb for example. Will that turn out to be discovered to be excessive eventually? Hmmm… And the subject PFOS limit proposed (2.7ppt) is lower than Charlotte’s current 3.6… and I have no idea what level our bottled water has… they list what is in it but don’t categorically state what ISN’T in it.
