I don’t know how they consider any of these consumer contracts to be valid. Every consumer at every moment in every commercial engagement has to know and understand what millions of dollars worth of corporate lawyers spent months or years dreaming up in the best interest of one of the parties. And they have to do it in a moment of time. They don’t have months and years nor do they have the benefit of knowing the outcome of any future court rulings.
If there is no choice to agreeing to the contract, then it is a sham document.
Exactly. The practice of: “in order to buy this good/service you must agree to the following” and “the following” is pages of legalese that no one can possible be held responsible for understanding, constitutes extortion. “Either your signature or your brains will be on that contract.” And, no. It’s not a choice.
All of that fine print is along the lines of “please don’t sue us.”. That should not stop you from suing when you have good reason. But do get a good lawyer. Expect the company sued to cite their fine print as their defense.
