A former head of the ICC was on Amanpour last night, explaining the complexities of prosecution.
-neither Russia, nor Ukraine, is a member of the ICC, so what happens there is outside the court’s jurisdiction.
-the UN could refer the case to the ICC, but Russia would prevent that with it’s veto.
I don’t know if what Zelensky is proposing is even possible, beside the fact that China would probably veto any move to expel Russia.

Then, of course, there is the problem of getting at Putin. War criminals were prosecuted in the Balkans, because a successor government allowed the prosecution. Chances of that happening in Russia are pretty slim.
