I couldnāt find any court case involving this. It seems like it is related to a question that Musk addressed at the January, 2025 conference call.
There is no current court case yet.

A judge has ordered Tesla to upgrade a customerās self-driving computer for free so that they can subscribe to Teslaās Full Self-Driving program without an additional cost. Itās a victory for customers frustrated with Tesla selling a self-driving package to customers before the company has actually delivered a fully functioning feature.
Tesla has claimed that all its vehicles produced since 2016 have āall the needed hardwareā to become self-driving with future software updates.

The headline was misleading. In the authorās opinion, Tesla should upgrade all vehicles to HW4. Based on the fact Musk made many false statements in order to sell FSD packages. Presumably, some people bought the package based on Muskās false statements. A reasonable person could conclude thatās fraud.
But currently, no Tesla has level 4 or 5 autonomy, so unless and until Tesla provides that for any vehicle, one could argue his promises have not yet come true, as opposed to being blatant lies.
Where are those computers sourced? Maybe China? Good thing that extra 125% tariff was suspended. Great timing too! Bet they arenāt done āstudyingā the issue and imposing a specific electronics tariff until Teslaās parts have cleared customs.
