Tesla may have to upgrade 4 MM vehicles to HW4, not just those who bought FSD package

Seems to be a consumer fraud thing.

I couldn’t find any court case involving this. It seems like it is related to a question that Musk addressed at the January, 2025 conference call.

There is no current court case yet.
But there has been a court case in the past.

A judge has ordered Tesla to upgrade a customer’s self-driving computer for free so that they can subscribe to Tesla’s Full Self-Driving program without an additional cost. It’s a victory for customers frustrated with Tesla selling a self-driving package to customers before the company has actually delivered a fully functioning feature.

Tesla has claimed that all its vehicles produced since 2016 have ā€œall the needed hardwareā€ to become self-driving with future software updates.

The headline was misleading. In the author’s opinion, Tesla should upgrade all vehicles to HW4. Based on the fact Musk made many false statements in order to sell FSD packages. Presumably, some people bought the package based on Musk’s false statements. A reasonable person could conclude that’s fraud.

But currently, no Tesla has level 4 or 5 autonomy, so unless and until Tesla provides that for any vehicle, one could argue his promises have not yet come true, as opposed to being blatant lies.

Where are those computers sourced? Maybe China? Good thing that extra 125% tariff was suspended. Great timing too! Bet they aren’t done ā€œstudyingā€ the issue and imposing a specific electronics tariff until Tesla’s parts have cleared customs.
