Pentagon officials declined to immediately release the terms of the plea bargain. The New York Times, citing unidentified Pentagon officials, said the terms included the men’s longstanding condition that they be spared risk of the death penalty.

This is sheer bumblery. KSM should have tried and convicted 20 years ago. Instead the Constitution hating Bh-C*y mental midgets screwed up to the point where he managed to get plea deal. Probably cost the taxpayers 10,000X of going through the traditional justice system. Major victory for terrorists everywhere.

Maybe the prosecution doesn’t really have much in the way of evidence, in spite of what the media has been 'reporting" all these years. Remember Jose Padilla? The government grabbed him off the street in Chicago and threw him in prison, without trial, claiming he had been involved in a “dirty bomb plot”. After years of heat about imprisoning a civilian, US citizen, without legal due process, he was finally put on trial, for something else. The “dirty bomb plot” story had been a fabrication by the government.

As for why the deal with KSM now? He is probably thinking, if the Shinies win in November, he chances of saving his skin would be zero. I would not be surprised if, in the event of a Shiny win, the plea bargain would be set aside and he would be executed anyway, based on his confession in the plea deal.

Not sure what ‘bumblery’ is, but I like the word!

As for a trial, this was always going to be iffy since the policies of a certain administration in the early 2000s chose to quarter KSM in black sites and then proceeded to waterboard him well over 100 times. Any evidence and testimony was severely compromised due to these “techniques”, along with any potential guilty verdict.

He never had any intention of being a martyr. If he did he would have been on one of those planes on 9/11. I don’t think he could have anticipated his enormous success of exposing the extreme cowardice and hypocrisy of American leaders, however.

There were problems with the evidence. Including torture. If they went to trial it would be hard to convict them. They are guilty and making the plea bargain saved them their lives. There was nothing more we could expect. If the death penalty was imposed it would take so long to the executions with appeals they would die of old age.

That didn’t age at all.

None of them are right - it is all part of the grift!
